This Privacy Policy explains how we collect, use, share, and protect personal data when you use our websites (https://momcozy.com/), application (Momcozy APP), social media pages, products (such as baby monitoring cameras, electric breast pumps, and other products), and our other products and services we may provide from time to time (collectively, the “Services”).

1. Who Controls My Personal Data
Where this Privacy Policy mentions “Momcozy”, “we”, “us”, or “our”, it refers to the Root company that is responsible for your personal data under this Privacy Policy (the “Controller”). The designated Controller is set out in Annex 1.
2. Personal Data We Collect
Depending on the relevant circumstances and applicable local laws and requirements, we will collect some or all the data listed below to enable us to provide our Services to you. To the extent applicable, such information may include:
2.1. Personal data that you provide to us
(1) Account Information. When you create an account, we might collect your phone number, account password, country/region, email address, name, and due date or your baby’s date of birth.
(2) Membership Information. To manage your membership, we collect your membership level and membership benefits (such as reward points or credits). We also collect information related to membership benefits and coupons, such as coupon redemption codes and gift card redemption codes.
(3) Profile Information. To manage your profile, we collect your region, name, email address, phone number, date of birth, role, bust size, number of breast pumps, due date, profile photo, demographic information, health information (such as medication, symptom) and phone number. When you create a profile for your baby, we collect your baby’s name, gender, nickname, date of birth, profile photo, weight, height, head circumference, stool pattern, sleep information (such as sleep duration), whether the baby was born prematurely, and records of bowel movements (such as form and color).
(4) Payment Information. In order to provide the Services purchased by you, we may collect your full name, email address, phone number, billing information, payment order details, shipping address, payment method, payment card number, and any other information that you provide.
Your Payment Information may be shared with our affiliates to facilitate the payment process, and the processor may vary depending on the platform you choose and your location.
(5) Feature-Specific Information. When you use specific features (such as baby name generator, ovulation predictor, pregnancy weight calculator, Chinese gender predictor, due date calculator, IVF due date calculator, first-year baby cost calculator, and child height predictor), we collect the relevant personal data required for such features, including your baby’s name, origin, meaning, initial letters, syllable preferences, ovulation period, weight, age at conception, and month of conception.
(6) Interactive Features Information. When you participate in online community interactions, we collect search history, user-generated content (such as posts and uploaded images), likes, favorites, and browsing history. Please note that artificial intelligence services may be used to assist in community management and to filter violent, obscene, or potentially offensive content.
(7) Information on Sweepstakes and Promotional Activities. We may collect personal data including your due date and email address that you provide for any sweepstakes or promotional activities that we offer. In some jurisdictions, we are required to publicly share information about sweepstakes winners.
(8) Survey Information. We collect information you provide in surveys, which may include menstrual cycle (including duration and last period), due date, baby birth information, feeding methods, planned breastfeeding duration, expected maternity leave start date and duration, number of children, whether the baby is currently consuming solid foods, mother’s age, underlying medical conditions (such as diabetes or heart disease), number of miscarriages, and delivery method.
(9) Customer Support Data. We collect information related to your inquiries and feedback, including the issues reported, email address, product information, order number, and other communications with customer support.
2.2. Personal data that we automatically collect or generate about you
We may collect personal data automatically when you use our Services, including when you use our website, applications and/or products:
(1) Usage Data. We may collect certain information automatically when you use our Services, such as your Internet Protocol address (IP Address), browser type, referring URLs, domain names associated with your internet service provider, and other information relating to your interaction with the Services.
(2) Device and Network Data. We may collect data that may be associated with your device or browser, including device identification information (such as IMEI, Android ID, and OAID), network connectivity status, device ID, model.
We may request access to your device’s location permission where required by the operating system to connect your devices through Bluetooth. We do not collect, access, or use your precise location data.
(3) Cookies Data. We, as well as third parties that provide content, advertising, or other functionality on our Services, may use cookies and other technologies (“Technologies”) to automatically collect information through your use of our Services. Please see “Cookies and Other Tracking Technologies” below to understand more about these Technologies.
(4) Product-specific information. When you use our products, we may collect certain personal data as necessary to maintain and protect our Services, monitor, manage, and optimize performance, and provide customer support and warranty services. The specific data collected will depend on the products you choose to install and/or use with our Services. Such data may include:
(i) Health Data, such as pregnancy and postpartum information, body temperature;
(ii) User Preference Information, such as device settings and preferences, including programs, schedules, timing, sound, and lighting preferences;
(iii) Monitor data, such as sleep records, sleep patterns, alerts for detected events (such as crying or prone sleeping), and event-triggered information (including thumbnails and event types), and, where applicable, physiological data such as heart rate and respiration. Please note that, your baby’s facial recognition results and voice data are processed locally and solely on your product devices and will not be uploaded to our servers; only the processing results are transmitted to the application; you may choose to allow or disable such feature at any time through our Services. Real-time video streams are not collected, accessed, transmitted to, or stored by us. Real-time video streams are stored either locally on an SD card or through a third-party cloud storage service, depending on the storage option you choose. If you choose to use a third-party cloud storage service, the collection, storage, and processing of such video data will be subject to the applicable terms and privacy policy of the relevant third-party provider.
(iv) Device Status Data and Usage Records, such as white noise settings, breast pumping task data (including pumping duration, frequency and volume), usage status, temperature patch records, humidifier status, device identifiers, associated product model, user identifiers, rating results, submission time, user reviews, and cumulative usage counts of specific features. Such data may continue to be collected while tasks are ongoing if the Momcozy APP is running in the background with the products being connected;
(v) Device Identifiers. During device discovery, connection, and binding, we collect identifiers such as MAC address, serial number (SN), Bluetooth identifiers, device broadcast name, and signal strength (RSSI)
2.3. Personal Data provided to us by third parties
We may obtain information about you from other sources, including through third-party services and organizations. For example, if you access our Services through a third-party account, such as Google Account, we may collect information about you from that third-party application that you have made available via your privacy settings.
3. How We Use Your Personal Data
We use your personal data for a variety of business purposes as described below:
3.1. Provide Our Services
We use your personal data to fulfil our contractual obligations and provide you with our Services, such as:
(1) managing your information and accounts
(2) providing the Services to you, including product device binding, as well as providing access to certain functionalities and features of our Services;
(3) processing your financial information and other payment methods for products or Services purchased;
(4) communicating with you about your account, activities on our Services, and policy changes;
(5) answering requests for customers or technical support;
(6) providing personalized recommendations to analyze your preferences and recommend content or services that you may be interested with;
(7) allowing you to register for events.
3.2. Administrative Purposes
We also use your personal data for various administrative purposes, such as:
(1) measuring and analyzing interest and engagement in our Services, pursuing research and development to improve, upgrade, and enhance our Services;
(2) detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activities to comply with our legal obligations;
(3) debugging to identify and repair errors in our Services to enforce our agreements and policies;
(4) authenticating and verifying individual identities, including processing requests to exercise your rights under this Privacy Policy;
(5) conducting audits relating to interactions, transactions, and other compliance activities.
3.3. Marketing and Advertising our Products and Services
We may provide you with content and advertisements through email, phone call, text message, push notification, social media or online advertising. This may include targeted advertising, as may be defined under applicable laws and regulations.

We also use your personal data for other purposes as authorized by you or as permitted by applicable laws and regulations.
4. Cookies and Other Tracking Technologies
We use these Technologies to automatically collect certain Personal Data when you use our Services to enhance navigation, analyze trends, administer the Services, track users’ movements around the Services, and assist with our marketing efforts and customer service.
You can manage cookies through your browser settings or our cookie preference tools, but if you choose to disable cookies, it may limit your use of certain features or functions on our Services including the website.

5. How We Share Your Personal Data
5.1. Affiliates and Business Partners
We share the categories of personal data described above in Section 2 with our affiliates and related entities, for legitimate business purposes and the operation of the Services, including assisting with payment services, which will in general depends on your country of residence and in accordance with applicable laws.
5.2. Services providers
We involve external service providers that perform services on our behalf, including:
(1) operating our Services and community activities,
(2) processing payments,
(3) fulfilling orders (including order processing, logistics, shipping, and delivery),
(4) delivering communications,
(5) providing customer support,
(6) managing customer relationships and converting potential customers,
(7) marketing/advertising services,
(8) hosting and maintaining databases,
(9) providing discounts, sweepstakes or other promotions,
(10) moderating community content and filtering inappropriate or unlawful information,
(11) data analytics,
(12) providing anti-fraud services
For the above purposes, we may also use third-party application programming interfaces (“APIs”) and software development kits (“SDKs”) as part of the functionality of our Services.
We have carefully selected these service providers and monitor them regularly, in particular their careful handling and safeguarding of the personal data stored with them.
5.3. Individuals you choose
If you use our device-sharing function or account-sharing, you may choose to authorize other individuals to access the video feed, recordings, and related information from your device/account, which may include personal data of your child. Please share access only with trusted adults who have a legitimate need to view such information. You are responsible for managing shared access, including adding or removing authorized users, and for ensuring that such sharing is appropriate and lawful.
5.4. Law enforcement agencies, public authorities or other judicial bodies and organizations
We may disclose personal data when required to do so by law or when we believe such disclosure is necessary to comply with a legal obligation or lawful process, including a court order, subpoena, warrant, or regulatory request. We may also disclose personal data to respond to requests from government or law enforcement authorities, to enforce our terms, policies, or agreements, to detect, investigate, or prevent fraud, security incidents, or other unlawful activity, or to protect the rights, property, safety, and security of us, our users, or others. Where permitted by law, we may make such disclosures without prior notice.
5.5. Change of corporate ownership
If we undergo a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets, personal data may be disclosed to prospective or actual buyers and transferred as part of that transaction. We will take steps to ensure that any successor entity continues to protect your personal data in a manner consistent with this Privacy Policy.
6. Data Security and Retention
6.1. How we secure your personal data
We have implemented appropriate technical and organizational security measures designed to protect your personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, unauthorized access, and other unlawful or unauthorized processing, in accordance with applicable laws.
However, despite these efforts to store personal data in a secure operating environment, we cannot guarantee the security of personal data during its transmission or storage on our systems. Further, while we attempt to ensure the integrity and security of personal data, we cannot guarantee that our security measures will prevent third parties such as hackers from illegally obtaining access to personal data.
6.2. How do we retain your personal data
We retain personal data for as long as necessary to provide our Services, fulfill the purposes described in this Privacy Policy, or comply with legal obligations, such as accounting, tax, or regulatory requirements. When personal data is no longer needed, we take steps to securely delete, de-identify, or aggregate it, unless retaining it longer is permitted or required by law.
7. International Transfers of Personal Data
The personal data we process is stored in the following locations: data of users in North America (Canada, the United States, Mexico) and certain countries in South America is stored in the United States, data of users in the European Union and the United Kingdom is stored in Germany, and data of other users in the Asia-Pacific region is stored in Singapore.
Because of the international nature of our business, your personal data may be transferred to, stored, and processed in the country/region other than your own. When we transfer personal data across borders, we implement appropriate safeguards to ensure your data remains protected in accordance with this Privacy Policy and applicable law.
8. Children
Our Services are designed for adult only and are not directed to children under the age of 18 (or other age as required by applicable laws). We do not knowingly collect or solicit any personal data from children as customers/users.
In the event that we learn that a child has provided us with personal data in violation of applicable laws, we will promptly take steps to delete that data. If you are a parent or legal guardian and think your child has given us their personal data, you can contact us as described in “Contact Us” below.
9. Your Privacy Rights
9.1. Data Access
You may have the right to know what personal data we process about you, including the categories of personal data, the business or commercial purposes for collection, the categories of third parties to whom we disclose it and other information according to the applicable laws.
You may also have the right to access and obtain a copy of your personal data in accordance with the applicable laws.
9.2. Data Correction
You may have the right to request that we correct inaccurate personal data that we retain about you, subject to certain exceptions.
9.3. Data Restriction
You have the right to object to or restrict our processing of your personal data in special cases. Even if you object to or restrict our processing of your personal data, we are still obliged to continue processing your personal data and reject your request where it is explicitly required under the applicable laws and regulations.
9.4. Data Deletion
You have the right to delete your account and erase your personal data. Upon deleting your account, all your personal data will be deleted. Additionally, you may also request deletion of the personal data you provide by contacting us. If some of your personal data cannot be deleted, we will inform you of the reasons for not taking action.
Please note that we reserve the right to retain some of your personal data where there are valid grounds for us to do so under applicable laws.
9.5. Withdrawal of Consent
Where we process your personal data on the basis of your consent, you may withdraw your consent by contacting us. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.
9.6. Right to Complain
You have the right to lodge complaints to the related regulators if there is any objection to our personal data processing activities or this Privacy Policy.
9.7. Other Rights
Depending on your jurisdiction, you may have additional rights under applicable data protection laws. For example, residents of the United States and the European Union may refer to Section 10 below for more information. We will comply with any other rights granted to you under applicable laws and regulations.
9.8. Account Sharing and Rights to Shared Data
If a primary account holder uses our account-sharing or device-sharing features to invite you to access a child profile, device, or related information, you may be able to view, add, edit, or upload certain data through your own registered account, depending on the permissions granted by the primary account holder and the features available in the Services.
The primary account holder may manage, change, or revoke your access at any time. For security and privacy reasons, if the sharing arrangement is terminated, or the relevant child profile or device is disconnected from your account, you will no longer be able to access, view, edit, upload, or otherwise use the data associated with the primary account through your account. If you have any questions regarding your access or the sharing arrangement, please contact the primary account holder directly.
9.9. Exercising Your Rights
The way in which you exercise rights depends on the specific product or service you use. In addition, you may contact us as described in “Contact Us” below. In some cases, it will be necessary to provide evidence of your identity before we can give effect to these rights. We will ensure the security of your personal data when you exercise the rights.
As a general rule, we provide responses to the exercise of your rights free of charge. However, we may need to charge a reasonable fee if the request is manifestly unfounded or excessive, or if necessary and unavoidable costs are incurred.

This Privacy Policy applies to all users worldwide. However, because privacy laws vary by location, we have provided additional details for specific regions. To ensure you have all the necessary information for where you live, please review this Section 10 for information that may apply to you.

This section supplements the rest of this Privacy Policy and applies to residents of U.S. states that provide specific privacy rights, mainly including California, Colorado, Connecticut. These laws grant residents certain rights regarding personal information that identifies, relates to, describes, or could reasonably be linked to an individual or household.

Please note that we will not process your personal data to develop and train artificial intelligence and machine learning models, unless such data have been aggregated, de-identified, or anonymized.
Some information processed through our Services may be considered as “sensitive personal data” under applicable law, including:
(1) Account credentials.
(2) Payment card information (collected and processed solely by our third-party payment processors that we do not have access to such identifiable personal data)
(3) Biometric information (collected and processed solely on your device; We do not have access to this data)
(4) Health data, including sleep patterns, heart rate, height, weight, body temperature, symptoms, medication and other body index relating to your and/or your child.
We process your sensitive personal data only when permitted and when the processing is strictly necessary to provide the services you requested. Still, depending on your state of residency and subject to certain legal limitations and exceptions, you may be able to limit, or withdraw your consent for, our processing of Sensitive Personal Data (as described in the “Your Additional U.S. Privacy Choices” below). You can also manage certain data collection features through your device settings or application preferences.
10.1.2. Your Additional U.S. Privacy Choices
Depending on your state of residence, you may have the following rights aside from those set out in Section 9 of this Policy, subject to legal limitations and exceptions:
(1) Right to portability: Where required by law, you have the right to obtain a copy of the personal data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance.
(2) Limit the Use of Sensitive Personal Data. You also have the right to request limitation of use and disclosure of your sensitive personal data, where such use goes beyond what is necessary to provide requested services. Please note that we use your sensitive personal data only as permitted by applicable law and necessary to provide and improve the Services.
(3) Do Not Sell or Share My Personal Data. We do not sell personal information for monetary compensation. However, certain disclosures of personal information to advertising or analytics partners may be considered a “sale,” “sharing,” or “targeted advertising” under applicable state privacy laws, depending on how those laws define such terms. Where required by law, we provide individuals with the right to opt out of these disclosures. You may exercise opt-out rights by:

Where supported, we also honor legally recognized browser-based opt-out signals, such as Global Privacy Control (GPC), for applicable activities. Please note this opt-out tool is website, device and browser specific, so you will need to change your preferences on each device and browser you use to interact with the specific website you are visiting.
(4) Appeal. You may appeal our refusal to take action on a request by contacting us using the contact details provided in Section “Contact Us” below.
(5) Non-Discrimination. California residents have the right not to receive discriminatory treatment by us for the exercise of their rights conferred by the CCPA.
10.1.3. Financial Incentives and Loyalty Programs
We offer various financial incentives to our customers, including:
(1) Discounts, coupons, and special offers via email when signing up for our email lists or creating an account;
(2) Rewards when referring to a friend who purchases our products; and
(3) Loyalty programs, where customers earn / redeem rewards based upon their past transactions with us.
To obtain access to certain of these programs and other offerings, we may ask you to collect your personal data, including account information, and payment information. We consider the value of these programs and other offerings to be reasonably related to the value of personal data to our business, based on our reasonable but sole determination. We receive value from our loyalty programs in increased customer loyalty and patronage, though any value will vary by member depending on purchases made, which offers a member takes advantage of, and many other factors.
Participation in our loyalty programs is voluntary. The terms applicable to each program and other offering are provided at the time an eligible customer is offered an opportunity to participate. Interested customers can opt-in to these programs and offerings by following the instructions presented at the time the offer is made. Participating customers may withdraw from our programs and other offerings at any time by unsubscribing from our emails (for email-based incentives), closing their accounts (for loyalty and reward program incentives), following the instructions provided in connection with each offering, or by emailing us using the information below.
10.2. European Union
This section provides additional disclosures required under the General Data Protection Regulation (GDPR). It applies exclusively to users residing in the European Economic Area (EEA), Switzerland, or the United Kingdom.

10.2.2 Lawful Bases
We process your personal data for the purposes described in Section 3 above, only when we have a valid legal basis to do so, including:
(1) We need to perform a contract with you: we process your personal data to fulfill our obligations under the Terms & Conditions you accepted. This processing is essential for delivering the Services you requested, as detailed in Section 1.1.
(2) You have given us consent to do so: for specific activities, such as processing health data or delivering certain marketing communications, we seek your explicit consent. You may withdraw your consent at any time by contacting us directly. You can also turn off or re-enable personalized recommendations at any time via [My] → [Settings] → [Recommendation Management]. Please note that withdrawing consent does not affect processing carried out before consent was withdrawn.
(3) Legitimate Interests: we process your personal data when necessary for our legitimate business interests, provided they are not overridden by your privacy rights. This includes activities such as analyzing user engagement to enhance and innovate our Services, as well as maintaining system security to protect against fraudulent or illegal activity and other administrative purposes listed in Section 1.2.
(4) Our Legal Obligations: we may process your personal data where we need to comply with our legal obligations under the applicable laws.
10.2.3 Other Privacy Rights under GDPR
While the rights outlined in Section 9 apply generally, residents of the EEA, Switzerland, and the United Kingdom are entitled to the following privacy rights under GDPR:
(1) Right to data portability
You have the right to obtain a copy of the personal data you provided to us in a structured, machine-readable format. Where technically feasible, you also have the right to request that we transmit this data directly to another service provider. This right applies only to data processed by automated means based on your consent or a contract.
(2) Rights related to automated decision-making
You have the right not to be subject to decisions based solely on automated processing, including profiling, that produce legal effects or similarly significant impacts, except where permitted by law.
